Recent changes to Florida law (Chapter 718) allow a condominium association to deny owners (or their tenants) the right to use common areas and recreational amenities when the owner is more than 90 days overdue in paying association maintenance fees. Additionally, the association may divert rent paid by a tenant and apply it to the delinquent assessments. Another change says that any amendment to the bylaws that would restrict a unit owner’s rights relating to renting the unit would only apply to those owners who consent to the amendment and to owners who purchase their units after the amendment was passed.
